States face uphill climb in suit over health law’s Medicaid expansion

The 26 states challenging President Obama’s healthcare law are facing several thorny dilemmas as they try to convince the Supreme Court to throw out the law’s Medicaid expansion.

Both of the lower courts that heard the Medicaid challenge ruled against the states, even as those judges struck down the healthcare law’s individual mandate. Legal experts on both sides of the debate over the mandate were surprised that the Supreme Court agreed to also hear the Medicaid piece of the states’ lawsuit.

Supporters of the healthcare law say the states made significant missteps in their initial brief on the Medicaid expansion, which was filed with the Supreme Court earlier this week.  More…

Repealing Obamcare Will Be ‘Hard’ If the ‘Case Isn’t Made’ in 2012

Crossroads GPS, the policy arm of the American Crossroads PAC, says a key factor in successfully repealing Obamacare in 2013 will be emphasizing the importance of repeal during the 2012 election campaign. National Journal quotes Crossroads GPS president Steven Law: 

 

‘“Typically during election years, both lawmakers and their constituents tend to be more focused on issues that need action so it’s a perfect window for us to be active this year,’ Law said. ‘Advocacy in the even number year can often have a determinative impact on policy making in the following year.’
